We are pleased to inform you of the latest Spanish court victories for July.M1 Legal secured THIRTY SEVEN positive court awards for clients totalling £620,389. The highest award from these latest results was against Amadores amounting to £40,411.
Please see below a breakdown of the substantive results: 1st Court of Instance:
- Club la Costa x 5 – The judge declared the contracts null due to lack of property and/ or contract duration information. (Laws 42/1998|04/2012). Amounts awarded – £35,941, £21,728, £21,414, £15,775, £10,189.
- Marriott x 5 – Also in Marbella, the judge declared the contracts null due to lack of property and/or contract duration information, (Laws 42/1998|04/2012). Amounts awarded – £33,456, £14,095, £9,728, £34,452, £14,100.
- Restotel – The judge declared the contract null due to lack of accommodation information. Amount awarded £37,493.
- Amadores – In our highest award for July, the judge confirmednullity of the contract due to lack of accommodation and contract duration information. Amount awarded £40,411.
We also received positive awards against Infiniti, Diamond Resorts/Hilton and Palm Oasis.
Appeals:
- Club la Costa x 13 – The Court of Appeal has confirmed thirteen judgments from the First Instance that declared the contract null due to lack of accommodation and/or contract duration information. (Laws 42/1998|04/2012) Amounts awarded – £12,091, £17,725, £19,706, £17,506, £11,300, £10,164, £15,271, £11,700, £19,795, £27,301, £15,080, £30,870, £12,347.
- Anfi x 3 – The Court of Appeal in Las Palmas has confirmed in full the judgments from the First Instance that declared the contracts null due to lack of accommodation information, (Law 42/1998). Amounts awarded – £13,438, £10,138, £19,386.
- Diamond Resorts – The Court of Appeal has confirmed in full the judgment from the First Instance declaring the contract null. Amount Awarded – £24,249.
