We are pleased to inform you of this week’s Spanish court victories. M1 Legal secured SIX positive awards with a total value of £122,105 which is an average claim amount of £20,350. Our highest award this week was against CLC Sucursal totalling £39,077.
Here is a breakdown of our substantive results:
1st Court of Instance:
- CLC Sucursal x 2 – In Arona, court No.1, the judge declared the contract null for both cases under the requirements of law 04/2012 (lack of information regarding the accommodation and contract duration). Amounts Awarded – £39,077, £19,238.
- Club Hotel La Dorada (Onagrup) – In Palma de Mallorca, court No. 8, the judge declared the contract null under the law 42/1998 for lack of information regarding the accommodation and contract duration. Amount Awarded – £20,573.
Appeals:
- CLC Sucursal x 2 – In Malaga Court of Appeal No. 4, the judgement was confirmed from the first instance for both these cases, which declared the contracts null due to lack of information (accommodation and contract duration). Amounts Awarded – £14,709, £12,585.
- CLC Sucursal – In Malaga, court of appeal No.5, the court confirmed the judgement from the first instance which declared the contract null due to lack of information regarding accommodation and contract period (law 42/1998). Amount Awarded – £15,921.

This week, our jurisdiction positive results were against Diamond Resorts and CLC Sucursal. In all three cases, the court rejected the appeal by the timeshare company to prevent court proceedings in Spain
