We are pleased to inform you of last week’s Spanish court victories. M1 Legal secured EIGHT positive awards with a total value of £136,117. Our highest award was against CLC Continental Resorts totalling £50,152.
Here is a breakdown of our substantive results:
1st Court of Instance:
- CLC Sucursal x 3 – In all three cases, the judge declared the contract null under the requirements of law 04/2012 (lack of information regarding the accommodation and contract duration). Amounts Awarded – £18,131, £18,767, £13,682.
- CLC Continental Resorts – In Arona, court No. 3, the judge declared the contract null under the law 04/2012 for lack of information regarding the accommodation and contract duration. Amount Awarded – £17,794.
There were also 3 further cases against Marriott, Anfi and CLC paradise, all of which had positive results.
Appeals:
- CLC Continental Resorts – In Tenerife Court of Appeal No. 3, we had to appeal against the judgement from the first instance that did not recognise the total price of the four previous contracts apart from the last one. The court of appeal confirmed nullity of all four contracts. Amount Awarded £50,152
