We are pleased to inform you of this week’s Spanish court victories. M1 Legal secured 8 positive results with a total amount awarded of £77,134.
The substantial awards are listed below:
1st Court of Instance:
- Diamond Resorts – The judge declared the contract null and void under the law 04/2012 requirements due to a lack of information regarding the accommodation. Amount awarded – £16,796.
- Anfi – The judge on this case also declared the contract null and void under the law 04/2012 requirements due to a lack of accommodation information. Amount awarded – £22,790.
We also had 6 further wins, 2 from the first instance which were against Anfi and Wayfair. The other 4 positive judgements were appeals, 3 were against Anfi and 1 against Tasolan. Total amount awarded – £37,548.
Jurisdiction
7 Jurisdiction Victories valued at £228,976.58
6 jurisdiction victories this week were all Club La Costa (with a claim value of £209,174) and one against McDonalds Resorts (£19,802). The defence argued that the cases should not be heard in Spain however, the judge has overruled they all can. With reference to all 6 Club La Costa cases, the judge declared that the Mercantile court in Spain is where these cases should be heard. The McDonalds case was an appeal and M1 Legal won this too. All 7 cases will now move forward.
