We are pleased to inform you of another fantastic week from our Spanish court victories. M1 Legal secured 2 positive awards with a total value of £101,690 which is an average claim amount of £50,845!
Here are the 2 cases:
1st Court of Instance:
- Onagrup – In court No. 60, Barcelona, the claim was confirmed fully upheld. The client’s contracts for 2008 and 2010 were declared null and void due to a lack of information regarding the contract period and accommodation information. Perblau 2000 SL was ordered by the judge to pay €32,294 plus legal interest from each of the payments. Restotel was ordered to pay double the amount of €41,364 plus legal interest from the date the claim was filed. The defendants are ordered to pay the costs.Amount awarded – £73,658.
Appeal:
- Club la Costa Continental – The Court of Appeal in Tenerife has confirmed this judgement still stands from the first instance which was declared null and void due to lack of information regarding the accommodation and contract period – Law 04/2012. Amount awarded £28,031.
Jurisdiction:
19 cases valued at: £486,260
This week we were victorious in 11 cases against Diamond Resorts which are valued at £262,226. All 11 cases were appealed by Diamond in an attempt to have the claims rejected under Spanish jurisdiction, these cases will now proceed to the next step.
Furthermore, there were 8 cases against Club la Costa that are awaiting the decision from the EU Court of Appeal which will then open the floodgates for similar cases against Club la Costa regarding the jurisdiction issue.
