We are pleased to inform you of the latest Spanish court victories. M1 Legal secured EIGHTEEN positive awards amounting to £317,587. The highest award from these latest results was a case against Marriott who were ordered to pay our client £66,955.
Please see below a breakdown of the substantive results:
1st Court of Instance:
- Marriott x 4 – In Marbella, the judge declared all four contracts null due to lack of property and/or contract duration information. (Laws 42/1998|04/2012). Amounts awarded – £16,437, £13,600, £11,675, £14,153.
- Marriott – On this next case also in Marbella, the judge declared the contract null due to lack of property and contract duration information. The contract between the plaintiff and MVCI Holidays S.L. along with MVCI Management S.L, resulted in the judge ordering Marriott to refund the contract price less weeks used at a rate of £769 per year until the issue of this judgment with interest. Furthermore, the judge also ordered Marriott to pay for payments made during the legal resolution period, plus legal interest from the filing of the lawsuit. Amount awarded – £66,955.
We also received a positive award against Elite Fuerteventura.
Appeals:
- Club la Costa x 4 – The Court of Appeal has confirmed four judgments from the First Instance that declared the contract null due to lack of property and/or contract duration information. (Laws 42/1998|04/2012) Amounts awarded – £20,402, £19,110, £34,764, £27,780.
- Anfi x 3 – The Court of Appeal has confirmed three judgments from the First Instance that declared the contract null due to lack of property and/or contract duration information. (Laws 42/1998|04/2012) Amounts awarded – £20,179, £11,571, £19,128.
We also received further positive decisions against Tasolan, Club la Costa and Anfi.
