Two more jurisdiction judgements were in our favour against Club La Costa this week. The contractual name in both circumstances being CLC Sucursal. Both of these cases were heard in Fuengirola Court and the value for each one is over £17,000.
There is a reference framework resolution for the issues raised regarding the jurisdiction of the Spanish courts in this type of contract, subject to law 4/2012. The judge referred to it in these cases. This is a set of equal decisions which are called “RESOLUCION MARCO”. This jurisprudence setting is the basis of almost all current decisions for similar contracts.
In addition to these jurisdiction victories, we also had a further substantive victory against Tasolán.
