Fourteen positive awards amounting to £177,272 including a case against Silverpont totalling £24,633

We are pleased to inform you of the latest Spanish court victoriesfor January. M1 Legal secured FOURTEEN positive awards amounting to £177,272.  The highest award from our latest figures revealed a case against Silverpoint totalling £24,633.

Please see below a breakdown of the substantive results: 1st Court of Instance:

  • MarriottIn Marbella, the judge declared the contract null due to lack of contract duration information. Amount awarded – £11,663.
  • Marriott – In this next case, nullity was declared due to undetermined purpose and duration along with absence of registration data. Amount awarded – £11,511.
  • Marriott –  The judge dismissed MVCI management’s lack of legal standing to bring proceedings therefore declared the contract null and void due to lack of contract duration and property information. Amount awarded – £11,415.
  • Marriott – In this case, the judge declared the contract null due to lack of contract duration and property information, lack of minimum legal content and the use of the term property. Amount awarded – £12,400.
  • Marriott – The judge dismissed MVCI Management’s lack of legal standing to bring proceedings, dismissed the delivery of general terms and conditions as irrelivant, and declared nullity due to lack of property and contract duration information. Amount awarded – £14,454.
  • Diamond ResortsThe case history revealed payment within the cooling-off period, and the contract did not comply with miniumum contract duration and property information therefore nullity was declared in our favour.  Amount awarded – £19,814.
  • Silverpoint – In Arona, Tenerife, the judge declared the contracts null due to lack of property and/or contract duration information. (Laws 42/1998|04/2012). Amount awarded – £24,633.
  • Heritage Resorts – In Marbella, the judge dismissed Playa Real Management’s delivery of the general terms and conditions as irrelevant and confirms nullity. Amount awarded – £11,726.

Appeals:

  • Anfi The Court of Appeal declared nullity due to lack of contract duration information.  Amount awarded – £17,041.
  • Diamond Resorts – The Court of Appeal has confirmed the judgment from the First Instance – The grounds in this case were failure to determine the minimum property requirements. Amount awarded – £16,090

We also received a positive appeal decision against Marriott.
All cases mentioned above will now proceed to the next step.
